Refunds will be issued at FreshStart Hosting’s sole discretion, and in client credit only. Product Addons, Upgrades, Client Credit and Terminated Services are all non-refundable. All products under our "Refund you if you're unsatisfied" pledge are not refundable if usage of the service exceeds 24 hours after the time of ordering. In addition, services which have breached our Terms of Service are not eligible for a refund. Domain names cannot be refunded nor changed after being submitted to the registry (when the domain shows as "Active" in your account, this usually occurs instantly upon payment). To request a refund, clients should contact the Billing Department via the FreshStart Hosting Ticket System.
FreshStart Hosting accept no responsibility for any issues which may arise due to late payments. Invoices are generated 10 days before they are due. Failure to pay for your service by the due date will result in suspension of the service. If the payment is not received within 7 days of the due date, the service will be terminated completely (all files deleted). For FreshBox VPS services, the service will be suspended at midnight on the due date if the invoice remains unpaid. The VPS will then be terminated (all files deleted) if the invoice remains unpaid for a further 3 days. We do not refund part billing cycles if any service cancels part way through a cycle, however there is always an option to cancel the service at the end of the current period.
FreshStart Hosting reserve the right to update our pricing structures with or without prior notice to our clients. Updates to pricing may affect active services, and if this is the case clients will be required to follow the new pricing structure, or cancel their service(s).
FreshStart Hosting permits clients to choose their preferred billing cycles. Clients can cancel their service at any time throughout their chosen billing cycle. If a service is cancelled whilst on the Quarterly, Semi-Annually or Annually billing cycles, any unused months can be refunded in client credit by contacting the Billing Department.
FreshStart Hosting allow subscriptions to be created with some gateways in order for clients to make payments automatically. By using our subscription system, clients are responsible for cancelling the subscription if they no longer require the service. Refunds for subscription payments which were not cancelled as appropriate will be issued in client credit only.
Disputes/chargebacks should not be opened with FreshStart Hosting; for refunds, the FreshStart Hosting Billing Department should be contacted directly via our support system. Opening a dispute/chargeback with FreshStart Hosting will result in suspension of all active services. In addition, FreshStart Hosting will not refund clients who open Disputes or Chargebacks, refunds will only be issued with approval from the FreshStart Hosting Billing Department. When registering for an account with us, you agree that all information submitted is legitimate and accurate. When registering for an account with us it is required that you inform us your consent to store your personal data, required by the European General Data Protection Regulation (GDPR). Please note you must be aged 16 and over to provide consent to store personal data.
FreshStart Hosting accept no responsibility for loss of data, regardless of the cause. Unless otherwise outlined, FreshStart Hosting accept no responsibility for backups of services, clients should use their own methods to regularly take backups of data. In the event that FreshStart Hosting offer complimentary backups of particular services, FreshStart Hosting make no guarantee that these backups can be provided or restored. Backups that FreshStart Hosting make are intended for our own recovery purposes, they are not intended as a replacement for clients taking their own backups.
By utilizing our services, clients accept full responsibility for their data and services, FreshStart Hosting will not be held accountable for any content clients store or use on our systems, FreshStart Hosting reserve the right to take appropriate action in the event of a breach of our Terms of Service. In addition, FreshStart Hosting will not be held liable for any losses which may incur, regardless of the cause. This includes, but is in no way limited to data, traffic and income. Certain services provided by FreshStart Hosting are resold. Thus, certain equipment, routing, software and programming used by FreshStart Hosting are not directly owned or written by FreshStart Hosting.
FreshStart Hosting reserve the right to suspend, limit, edit or terminate any services at any time with or without prior notice, and for any reason at our discretion. FreshStart Hosting also reserve the right to refuse a customer use of our services, for any or no reason at our discretion.
We do not guarantee that all promotions and their respective promotional codes (if applicable) that are provided by us will remain operational. We reserve the right to remove any promotion and their respective promotional codes (if applicable) at any time.
When utilizing FreshStart Hosting services, clients are limited to a maximum of one client area account per person. FreshStart Hosting do not allow clients to hold multiple accounts, regardless of the reasoning behind this.
By utilizing our affiliates system, clients agree to use the system legitimately, clients may not spam or falsely advertise others, additionally, clients may not use the affiliates system to refer themselves or duplicate accounts. FreshStart Hosting reserve the right to modify the given commission at any time. FreshStart Hosting will add the referral funds upon withdrawal to your client credit balance only.
FreshStart Hosting utilizes a range of fraud tools including FraudLabs Pro and FraudRecord to screen new orders for previous fraudulent activity and report existing clients who violate our Terms of Service. In case of a violation, you may be reported to FraudLabs Pro and / or FraudRecord for misbehaviour using one-way hashed information. In the event that FreshStart Hosting detect suspicious activity, we reserve the right to request clients verify the information that they have provided, or request additional verification to ensure the legitimacy of the order / account.
The user agrees that no attempt will be completed to modify the originally purchased specifications of their product/service. Any attempt to do so will result in a termination of service. Spamming of the livechat or ticket system will not be tolerated and will result in methods to halt such spamming being implemented. Please provide us at least 24 hours from the time of submission to respond to your requests. While some services offer unlimited/unmetered features (for example: FTP accounts) we reserve the right to remove any excessive files that may impact the host server to prevent any data loss. Unlimited web hosting packages with unlimited file storage are only to be used to host files related to your website, and not a file hosting service for example.
Web Hosting – The following are not permitted on these services:
• Display, store or distribute any pornographic, privated, excessively violent or illegal content,
• Distribute or host files that contain malware, viruses or any harmful computer software
• Operate an auto-refreshing script that refreshes more than than once every 20 seconds
• Any copyrighted content without the rights/permission to the/use particular file or files
• Host any illegally sourced files or directories on their service
• Host any form of website in which may be considered a 'Phishing' attempt
• Utilise this service in order to distribute/send mass/spam emails (accounts are limited to 25 emails per hour)
• Anything illegal or unethical, under the discretion of FreshStart Hosting's management team
FreshBox VPS - The following are not permitted on these services:
• Spamming/Mass mailing
• Port scanning
• Malware/Viruses etc
• Traffic exchange
• Cryptocurrency mining
• Private/Illegal/Pornographic content (this includes storing/displaying/distributing this type of content)
• Threatening or obscene material
• Copyrighted material (without authorisation)
• Booters/DDoS attacking software (including front end websites)
• Anything illegal or unethical, under the discretion of FreshStart Hosting's management team
• Anything outlawed within the United Kingdom of Great Britain and Northern Ireland or the United States of America
• Consuming resources including Processing, Networking and I/O that negatively affects others on the host system
Virtual Server (FreshBox VPS) Processor Usage - A Virtual Server may not utilise more than 50% of its allocated cores for more than two hours at one given time. There must be a break period of at least one hour in between the two-hour period. An example of such is a user’s Virtual Server having two cores allocated, this means that the user may not access more than 100% processor consumption for more than two hours at one given time. If the processor usage becomes disruptive, we reserve the right to restart, shutdown or suspend the Virtual Server.
In the event we receive an abuse complaint, this includes copyright notices and DCMA notices. The user will be forwarded the received abuse complaint. We will provide the user up to 24 hours to reply with a resolution to the abuse complaint. In the event we do not receive a reply within the given 24 hours from forwarding the abuse complaint the involved service will be suspended pending a resolution. In the event that the abuse continues on a recurring basis then we reserve the right to terminate the service involved. A resolution is seen as an act which will prevent the abuse from recurring.
